Draft Lease of Land in the parish of East Wellow Hants for the purpose of a Brick and Tile Manufactory (from papers ‘rescued’ by LTVAS from those left by Deacon, Stead and Tylee, Solicitors of Romsey)
This Indenture made the day of 1854 Between William Edward Nightingale of Embley Park in the parish of East Wellow in the County of Southampton Esq. of the one part and Cornelius Beavis of Shirley in the parish of Millbrook in the said County of Southampton Builder and Henry Canning of Greenwich in the County of Kent Gent. of the other part Witnesseth that in consideration of the yearly rent etc to be paid etc. He the said W.E.N. doth … grant lease and demise unto the said Cornelius Beavis and Henry Canning … All that piece or parcel of land part of Wellow Common containing by admeasurement 11a. 3r. 11p. bounded on the west by the boundary line between the Counties of Wilts and Hants, on the east by an intended new bank on the south by the Salisbury and Eling Turnpike and on the north by land in the occupation of James Moody … together with …. And together with full and free right for them the said Cornelius Beavis and Henry Canning … to remove and carry away manufactured or unmanufactured any brick, earth, clay, loam, and sand from and out of the said lands and also to manufacture the same into bricks, tiles pipes or other articles thereon and to sell and dispose of the same …. And also liberty to erect on the same any kiln or kilns … for purposes of carrying on the said trades of brick, tile or pipe manufacture …. except reserving to W.E.N. rights of timber, game, mines, minerals and manorial rights To have and to hold the said demised premises … for the term of Twenty one years from the 25th day of March last past …. Yielding and paying yearly and every year during the term hereby granted the rent of Thirty pounds …. …. And will also in digging for Brick Earth Clay and Loam in the said demised lands avoid excavating the surface below the level of the brook running by the said premises and carefully remove and later replace the top soil ….
